1. At a glance
This website presents Bergfeld Software GmbH. We limit data processing to what is needed to operate it:
- We use no analytics, no advertising and no tracking, and we create no usage profiles.
- We set a single cookie. It only remembers the language of the website.
- We load no content from third parties, with one exception: the security check of the contact form, which is provided by our hosting provider. Fonts, maps and images are delivered by our own website.
- We receive personal data from you only when you contact us.

4. Hosting and server log data
This website is hosted by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. Each time you open a page, your browser transmits data that Cloudflare processes on our behalf in order to deliver the page and to protect it against attacks and misuse:
- IP address
- date and time of the request
- address of the requested page and of the page you came from (referrer)
- browser type and operating system
- status code and amount of data transferred
We do not combine these data with other sources and do not use them to identify visitors. Log data available to us is deleted automatically after seven days at the latest.
The legal basis is Art. 6 (1) (f) GDPR. Our legitimate interest is the secure and reliable delivery of this website.
Cloudflare acts as our processor under a data processing agreement pursuant to Art. 28 GDPR. Cloudflare operates a worldwide network, and requests are normally answered by a data centre close to you. A transfer of data to the USA cannot be ruled out. Cloudflare is certified under the EU-U.S. Data Privacy Framework, for which the European Commission has issued an adequacy decision pursuant to Art. 45 GDPR. 5. Cookies
This website sets one cookie:
- Name: NEXT_LOCALE
- Content: the language of the page you viewed, either de or en
- Purpose: to take you to the right language version when you open the website again
- Duration: until you close your browser
The cookie contains no identifier and cannot be used to recognise you. It is technically necessary for the language selection, so no consent is required under § 25 (2) No. 2 TDDDG. The legal basis for the processing is Art. 6 (1) (f) GDPR.
As we use no cookies that require consent, this website shows no cookie banner. You can block or delete cookies in your browser settings. The website remains fully usable without the cookie.
6. Contacting us
Contact form
If you write to us using the contact form, we process the details you enter: company, name, email address and your message, together with the time of sending. The data is transmitted in encrypted form and used solely to handle your enquiry.
Your message is forwarded to our mailbox by email. For this we use the email delivery service Resend, provided by Plus Five Five, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA. Resend acts as our processor under a data processing agreement pursuant to Art. 28 GDPR and processes data in the USA. Resend has committed to the EU-U.S. Data Privacy Framework. In addition, the standard contractual clauses of the European Commission have been agreed. Further information: https://resend.com/legal/privacy-policy.
The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR, which you give by ticking the box in the form. If your enquiry relates to a contract or to steps prior to entering into a contract, the legal basis is also Art. 6 (1) (b) GDPR.
You can withdraw your consent at any time with effect for the future. An informal email to us is sufficient. Using the form is voluntary. You can also reach us by email or telephone.
Protection against misuse (Cloudflare Turnstile)
To protect the contact form against automated misuse, we use Cloudflare Turnstile, a service of our hosting provider Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. When you open the page with the contact form, your browser loads a program from Cloudflare that checks whether the form is used by a person. For this purpose Cloudflare processes your IP address and technical information about your browser and device. In most cases the check runs unnoticed. Turnstile does not use the data for advertising and sets no cookies for tracking.
The legal basis is Art. 6 (1) (f) GDPR. Our legitimate interest is protecting the form against spam and misuse. As far as information on your device is accessed, this is technically necessary for the secure operation of the form pursuant to § 25 (2) No. 2 TDDDG. The information on Cloudflare as our processor and on data transfers in section 4 applies accordingly.
Email and telephone
If you contact us by email or telephone, we process the details you give us in order to handle your request. The legal basis is Art. 6 (1) (b) GDPR if your request relates to a contract, and otherwise Art. 6 (1) (f) GDPR. Our legitimate interest is answering the enquiries addressed to us.
Storage period
We delete your enquiry as soon as it has been dealt with and no statutory retention periods apply. Business correspondence is subject to the retention periods of German commercial and tax law.
Recipients
We do not sell personal data and do not pass it on to third parties for their own purposes. Data is accessible to the service providers that process it on our behalf, such as our hosting provider and our email delivery service, and is otherwise disclosed only where the law requires it.
7. Directions and external links
The map on our directions page is a static graphic that we produced from OpenStreetMap data and deliver ourselves. Viewing the map does not establish a connection to a map service.
The buttons for Google Maps and Apple Maps and all other references to external websites are ordinary links. Data is transmitted to the respective provider only when you click such a link. From that point the privacy policy of that provider applies.
The support portal for our existing customers at support.bergfeld.aero is a separate service. This privacy policy covers the website bergfeld.aero only.
8. Fonts
The fonts of this website are stored together with the website and delivered from our own address. No connection to Google or to any other font provider is established.
9. Your rights
With regard to your personal data you have the following rights under the GDPR:

- right to data portability (Art. 20)

To exercise your rights, an informal message to us or to our data protection officer is sufficient.
Right to object
Where we process your data on the basis of Art. 6 (1) (f) GDPR, you have the right to object to this processing at any time on grounds relating to your particular situation (Art. 21 GDPR). We will then stop processing the data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves to establish, exercise or defend legal claims.
Right to lodge a complaint

This website is delivered exclusively over an encrypted connection (TLS). You can recognise this by the address beginning with https and by the lock symbol in your browser.
11. Automated decisions
We do not use automated decision-making or profiling.

We adapt this privacy policy whenever the website or the legal situation changes. The version published here applies. This policy is provided in German and English. In case of doubt, the German version applies.
